Marketplace Participation Agreement
These role-specific terms are recorded with a version, language, time and integrity hash. They allocate practical duties but do not remove rights or obligations that applicable law does not permit a party to waive.
- Lopez Motos connects renters with identified hosts. The renter pays the disclosed Lopez Motos reservation/service fee online in addition to the host’s full listed rental price. The host supplies the rental, receives that full listed price directly at pickup and, if disclosed, separately receives the cash deposit. This description does not override any legal classification imposed by law.
- Before paid confirmation, both parties must use Lopez Motos messaging and may not exchange phone numbers, email addresses, social handles, external links, external booking or payment routes, or an exact handoff address. Splitting, spelling, encoding or placing those details in public text or images is also prohibited. The public host name, operating city, platform support and any supplier information legally required before contracting remain available.
- The host warrants ownership or authority, lawful rental use, accurate listing terms, roadworthiness, taxes, current mandatory insurance and written confirmation that the intended paid third-party rental is permitted. The host must present original registration, insurance and other required paperwork at handoff.
- The renter warrants the required age, identity, experience and valid licence class, follows Moroccan law, inspects the moto and verifies original paperwork before riding. The renter must refuse handoff when identity, vehicle, condition, licence match or paperwork is missing or inconsistent.
- A cash security deposit is optional and its exact amount must appear before the request. It is paid directly to the identified host, never charged or held by Lopez Motos. The host records collection in the website checklist, Lopez Motos generates a time-stamped digital receipt, and the renter acknowledges or disputes it online. The host must document handoff/return condition, promptly return the unused amount and provide an itemized statement plus supporting photos, estimate or receipt for any deduction.
- Before pickup, the host completes the shared website checklist for identity, original documents, odometer, fuel, equipment, safety, condition and any cash deposit collected. Lopez Motos generates the time-stamped digital receipt; the renter must acknowledge or dispute it online. Before completion, the host submits the return condition and a reconciliation showing cash returned plus itemized, evidenced deductions equals cash collected; the renter again acknowledges or disputes it online. Complaints receive a written human decision, notice, a deadline and an appeal route. Suspension or removal requires a recorded human rationale and appeal opportunity.
- Lopez Motos does not currently provide supplemental rental insurance. The host remains responsible for legally required and rental-compatible coverage; the renter remains responsible for checking the documents and understanding personal coverage. An agreement cannot replace mandatory insurance.
- The Lopez Motos reservation/service fee is generally non-refundable for a renter change of mind, schedule change, no-show, late arrival, inability to present the required licence or refusal after a compliant host handoff, to the extent permitted by law. The narrow refund exceptions are host cancellation; an unavailable, materially different, unsafe or noncompliant moto; Lopez Motos being unable to perform the booking service; a duplicate or unauthorized charge; or a refund required by applicable law or the payment provider. After pickup begins, renter cancellation is unavailable; genuine safety, fraud and non-performance claims enter dispute handling without limiting non-waivable rights.
- Payment or deposit abuse may be reported. Lopez Motos may preserve evidence and, after human review, notice and an appeal opportunity, suspend or permanently remove an account for a documented platform-contract violation. Suspected crime should be reported to the proper authorities.
- Each party accepts ordinary inherent riding risks and the stated division of duties only to the extent allowed by law. Nothing excludes mandatory insurance, statutory consumer rights, fraud, willful misconduct, gross negligence, bodily-injury liability or any other non-waivable duty.
